AZ: Truck driver forced to show birth certificate claims racial-profiling

Who gives a shit about his side of the story? He wasn't charged with anything, that's the side of the story that should be a red flag. The entire point of the matter is that police officers shouldn't be asking you for your birth certificate.
 
Why not? Not that I want to carry mine around, but what is your argument against this?
 
Nope, but apparently all the information necessary to answer this question, though posted in the king's own by myself prior to making the post you quoted, is not enough to forestall questions either.
 
huh? no.... Joe_Cool is trying to argue that reasonable suspicion has no subjectivity to it.
 
Correct. But he can detain you if he has reasonable suspicion that you have committed or about to commit a crime. Which is what I said.

Just talking to my mom down in Phoenix. There's alot more to the story.

He originally refused to give any information about himself, name, ssn, license, etc. to the weigh station officials.
When he was asked to provide his license he said he didn’t have one then they asked him where he lived and he said "I don’t know where do you think? My family lives in Mexico so what does that tell you?"

It was only after he was detained and sent to immigration to find out who he was that he provided identification.
 
And according to the SCoTUS a first and last name is all you're required to give. How are you going to suspect if someone is lying if that's all they give the officer?
 
So you were answering his straw man with a straw man? Interesting. He was asking if a cop could detain you for not having ID.

Since the subject of the thread is a truck driver at a weigh station, all of the issues about not requiring documentation are moot. Truck drivers are required by law to have all kinds of documentation, and there are literally thousands of reasons he could have been asked almost anything related to what he was doing, and been required to prove it.

Such is the way it works in that world.
 
And the answer is a cop can only detain you if he has reasonable suspicion that you have committed a crime. Why is this so fucking difficult for everybody to understand?
 
Ah, but SCOTUS says the only ID I need is my name. Therefore, all these private companies are in violation of a Supreme Court ruling as to what ID is required...
