take the time to pull out a vinyl disc and notice how you can hear 'cross talk' before the tune begins....think about it...then think about how one could (and it IS done) pull data off of the ridges of the disc...yep...that is how it is done...

I personally stay away from all filesharing, newsgroups, and any other unsafe house of porn. I don't know how many of the cases where people in this thread who got in trouble are actually an accident or they are just lieing to themselves, but I would not take the chance. Through a combination of the justice systems and general publics ignorance of technology and incredibly harsh laws for mere possession, and then with filesharing it becomes 'promotion' as well, it's simply to risky to go to those places for good ol' legal pornography.

This article should rightly scare the pants of you if you downloaded anything like that; these guys are in the worse possible position. It's impossible to tell who might be a victim of circumstance and who has a major problem with this kind of stuff because they lump them all together and call them 'vile, disgusting deviants'. Thanks to recent Florida law changes by politicians looking for easy targets, these guys are facing the same kind of sentences murderers face.

if you take the time to read this overly long thread in full you will see that I do advise overwriting files when needed...this will make them go away as best as can be done....BUT...they are still there if one wants to spend the time and money (and its really not all that much when taken in the big picture) to get at them...its not star trek technology (which is of course at this time fiction), its real technology out there right now...let's say you were a political figure and someone was out to get you...they knew you did such things and were out to prove it...they could if they got a hold the your HDD...are you getting my drift, or do I need to pull out a sledgehammer and beat it into your skull?

@Remoc....it is possible to mistakenly download such stuff...misnamed files, files with names such as DSCN_1023..yep, I've come across a few with names like that when I'm blindly downloading images just for giggles to see what's out there...I have to say you would be surprised at some of the images people have in their shares (probably because they allowed LW to search their drive for media files to share)...the heart of your response is correct, but I just want to make it clear that it is possible to end up with a nasty file by total mistake...
 
Note that sharing was the issue again. It always is.

Actually, showing up for a moment as a potential source for
the file would automatically trigger an additional search
through the same network. That's just normal police
procedure which doesn't require a warrant or even any form
of personal contact. But not showing up again as a source
and not being findable in a search for the same file and not
showing any suspect file in a browse is always going to
result in the same thing, being dropped for probable
suspects who do show up on the search and stay there.

The key concepts here are reasonable suspicion
and probable cause.

Reasonable suspicion is grounds for further investigation
but not a warrant, and only if that further investigation
brings up probable cause can any further action be taken.
It's as simple as that, and there's no getting around it. It's
the law everywhere in Europe, North America and all other
countries with a constitutional government and a highly
developed legal system. Any experienced police officer or
prosecutor will confirm it if you go and ask. This legal
principle goes right back to the days when modern law as
we know it was first brought forth and put into force.

There would never and could never be a warrant issued for
a single hit on a single download attempt and police would
never stop checking to avoid not finding corroborating
evidence just so they could beg for a warrant based on one
possible hit.

Show us one person in the whole planet who was ever even
questioned for an accidental download which they then deleted.
Just one will do. How many years did that one get?

Never, ever forget: The only thing that will get any
movement at all is a definite indication of sharing of such
files. That means documented verifiable proof that can be
brought to court. A possible indication of a download
attempt which may or may not have failed is not enough if
further investigation yields nothing. This is particularly true
when investigators already have plenty of probable cause
on dozens or even hundreds of other people to work on, and
we already know is happening everywhere because of reports
in the news on the topic.

Clinging to an untested theory for the sake of argument is
not helping those few people who come here for info about
what to do with accidental downloads. If you know
anybody in law enforcement or the courts ask them about
the distinction between reasonable suspicion and probable
cause, or search the web for articles that mention both
terms with that specific wording. Once this central and
basic concept of the law is made clear you will understand
a lot about how the law, the courts and the police work
together to protect the rights and privacy of people like you
and your fears will be somewhat relieved.
 
Yeah, probably 39 FBI officiers, other bozos trolling paedophiles or people that are too ******* curious. Have you ever considered that these might have been people just like you who have downloaded this without knowning what it is? Most P2P software nowadays shares a file whilst downloading it. You might have uploaded parts of it as well.

There may as well be hidden pictures within whatever files you've ever downloaded. It's trivial to hide a few megabyte of data in a movie, for example. Perhaps "the scene" has a custom tool hide in and extract data from such files. It doesn't even require encryption or anything complicated. Most file formats offer a way to include some data which will simply be ignored by players/viewers.

Keep in mind that the vast majority of child abuse (sexually or not) happens in the FAMILY by the father, uncle, brother and all women aren't innocent either. People are just wasting their time and energy by blathering over this issue with respect to videos and photos on the internet. It's just a symptom not the real problem. Some useless politicans even dare to abuse the issue to create a police state in which everybody and everything can and will be completely controlled with no freedom left.

It would be far better if everyone takes care that such things cannot happen in his own family and neighbour hood.

Even if you shut the whole internet down, the abuse of children will continue. If you stop the abuse of children, there won't be any videos or photos to put on the internet.
 
I dont think he was using any p2p software, he paid for it and he was found in possession and used "research" as an excuse, doesnt really wash does it
 
Wiping won't save you either if they've got the file they uploaded from you. The paper recently had another story of the guy who got his computer ganked after the Secret Service notified local authorities he may have KP on his computer. He said it was completely accidental but he wasn't in a big hurry to admit he downloaded piles of porn to the local paper. They still wanted to charge him over the 2 files.

It's also common to get charged for "destruction of evidence" if you wipe your drive before they come knockin'. One guy who was trading KP wiped his system once he heard they were coming for his computer. Somehow he got an investigator who decided to get the computer after the initial interview. He wiped it before they came back but they had evidence of the files by virtue of what they uploaded from it on the P2P.

It's impossible to prove innocence once they show up. And god forbid if some trojan is using your computer for this sort of thing. I doubt anybody will buy your story. You'd almost have to have a screen log program tracking yourself , keeping a video timeline of what you do on your computer to prove you were actually deleting the stuff the moment you realized what it was. It'd be the only way to demonstrate you weren't some degenerate using the pictures as your desktop background.

Hmm, a new excuse for full time government tracking of your computer: "We'll protect you from kiddie porn and won't throw you in PMITA prison!"
 
And on a mac you'd use Secure Empty trash as compared to the normal routine. Or to make doubly sure a utility like norton's wipe info which gives you the option of wiping a folder or empty space to clear any traces of data.
 
In the USA yes it is. There are numerous States that have specific laws that cover this. For example in New Mexico you can receive a Life Sentence for having such material on your hard drive.

You will need to check your Local, State, or National Laws.

But personaly I think any one who has this type of material is a real sicko, and should get what they have coming.

I have recently had the same problem as a few others here, downloading everything that shows up as search results, including ******* kp (searching for videos with the keyword "young" is a bad idea!! - I expected to get 18 year old variety stuff, not toddlers). Your comments are definitely making me feel better. I have been constantly scrubbing my hard drive since I found i had that **** downloaded.

I still fear that the feds are going to show up at my house and take my computer and inspect it and find something and give me some 5-10 sentence because I was "in possession." I have never been a paranoid person or even worried about the government watching me, but now I just feel like a dirty fugitive.

I really hope you are right, that if I did fall into some kp sting trap on gnutella that my deleting the files (I actually stopped most from finishing dl'ing) would exonerate me. I still hate this feeling. I didn't knowingly do anything wrong but this country could still put me in federal prison for several years if they so chose.

Furthermore, the post below by killians is ******* horrifying if it is true in its entirety. It is all I can think about right now. P2P porn is obviously not worth it with all the sick ****ers sharing kp.

It's different on magnetic media. A secure delete routine throws enough noise at it to clean up
the edges too, which is why they run so many passes. What you're talking about is roughly
analogous to having never tried a secure wipe at all, which on vinyl would be like scraping out
the grooves so that even the crosstalk is gone.

At that point maybe Ensign Kim could recover something with a tricorder and some Borg
technology but probably not, since he's out of town and the Borg stuff is really expensive.
 
I am qualified to respond to these questions, but this will be my sole post. I will try to keep it short and sweet.

As for what they can do to minors, that varies from jurisdiction to jurisdiction. Prosecution of minors is a very gray legal area. But, Just. Stay. Away. It's not worth it.

I did not read the entire thread, but some people on here were giving bad advice. Do. Not. Ever. turn in child porn to the Feds. If you discover child porn you need to let them know the location of it, but not actually give it to them. POSESSING CHILD PORN IS ILLEGAL. By all means, tell them where they can find it, but do not have a whiff of it on you. However, there are many volunteers who turn in locations of child pornography to the police - this is a very good and noble act. Just be really, really careful. People who have turned in tapes of child porn have been busted for posession...digital downloads are the same thing, legally. So point out, but do not touch. Pretend you found a gun on the side of the road. Sure, call the cops - but don't get your fingerprints or DNA on it.

Most, and I emphasize the word most, people get caught by sharing it. It's the same way with illegally obtained music. If you accidentally download child porn, the first thing you need to do is get it out of the shared folder. The second thing you should do is uninstall the file-sharing program (you can reinstall after this is all said and done). Then download an erasing program. Research it to make sure it is what it is. I recommend at least seven passes with a DoD overwriting algorithm. Good erasure programs will have a few options. ERASE the file in question - don't delete it. (Most erasure programs delete and erase at once.)

Once you've erased the file, then go clear all of your history, temporary internet files, cookies, and document history. Then reboot. Then you want to use the erasure program to overwrite ALL of the free space on your hard drives. I would suggest doing this a few times (with different algorithms) - just in case.

At this point you should be good to go. Running a defrag couldn't hurt either. Also make sure you have anti-spyware and anti-virus software up to date and run them weekly. (This should be done anyway.)

At this point, they'd need an electron microscope to get the data off your hard drive, which is way too expensive to use in prosecution for...well, for most things. Even then, them getting data is a maybe, at best.

If you really think the cops are coming and you've done all of this, then you could reformat your hard drive. If you KNOW that there is a warrant out for you (but have not been given an order to preserve data, which is rare), after the re-format you'll want to degausse the hard-drive using electromagnets. Then make the hard drive disappear. At that point you're 99.999999% sure that they won't be able to get anything.

However, sometimes corporations or government organizations are ordered not to destroy data. Obstruction of justice is a serious charge...the chances of that being applied for this reason in a single criminal case is low.

But, for all intents and purposes, clearing out your history and erasing the file, and then all of the free space on your hard drive is the best way to go. You can sleep well and still use your machine again.

However, the best way to do it is just be really selective on what you download. Do not do massive downloads and pay attention to things as they come in. If you catch something, you catch it right away, before it gets shared.

Anyway, be safe, don't search for it, and be moderately paranoid, and you should be ok!
 
Have you tried Safe Mode? Maybe some active program is interfering with Explorer and Safe
Mode might let Windows start without it.

In any case you do have a serious problem and you should get somebody to put hands on and fix it.
 
I understand. If you'll notice, my post was a response to someone who stated they did it on purpose, not by accident. The thing is, we have a sheriff a county over that is basically wiping the floor with people for this crime over and over, it seems like every few months there is a new story in the paper with 20 or so guys in deep doo-doo and I can't see how he differentiates between uploaders or downloaders, he looks for anyone and everyone that he can catch with evidence. So when I read this thread and all these guys, I get a little worried for them, not judgemental. I am worried that for such a dumb, thoughtless act they could face serious consequences. So, please excuse my prostelytizing, it's really only meant to be a danger flag. And I don't to plan to wave it again.
 
thanks man, i just dont find it cute that people tag things like this and even if it isnt real, it still makes people ill. anywho, what cleaners do you recommend. i dont even know what to type in the search engine other than "computer cleaner"
