here in the US, it is both illegal to possess, as well as selling, trading or any other venue of KP.....I was trying to find a movie myself (not porn) and damned if some kiddie porn came up of a 9 yr old having sex with an adult and what is worse, there were 39 users that had this same file on their pc....makes me sick to my stomach...anyway..back to the issue....it is illegal to own it in any form or shape...and no one wishes that I start on those that like to even watch it

I, too, question why the authorities were looking into your bro's computer.

Charged with posession of child porn, when the only evidence is 14 filenames that could not be verified? A prosecutor admitting to "exaggerating" criminal charges? A lawyer telling a defendant to plead guilty at arraignment? (With only one hour to prepare for a case, the standard practice is to plead 'not guilty' and waive time. The plea may change at a later date - after further review of the case and discussion with the DA.) Was this in the US (what city, state)?

If the "girl tied to a bed..." was made to appear underage (even if she was over 18), and the title implied child porn, then posession of the file could be a criminal offense. But you said he was downloading music.

A program that changes the filenames as I'm downloading them is a new one on me.

A defrag will reliably scrub the remains. If you have Norton's software you
can set Speed disk to run every night.

Since you're not building or sharing major collections the authorities have no
interest in you whatsoever and even in the impossibly rare case they do, you
can reasonably assert your innocence by the fact you did delete the few files
you did get by accident.
 
This is one thing that is a universal crime to some extent everywhere....but I knew a perv once who taped (hidden) guests going to his bathroom...this sick twisted lump got it when the cable modem guy came over to check out his modem and found footage of young girls (daughter and friends) going to BR/shower, without being aware of this camera...He got a warning! A warning!
 
They do it under the guise of "general deterrance". I might believe that, if I had also read that a few producers of CP were busted. Surely there are a few idiots out there who download a lot of CP and then share or seed it. And they should be easier to find that a kid with one deleted file.

Haven't heard of any bankers or Wall Streeters going to jail, either (but at least we know that Martha Stewart learned her lesson!).

Aaron, in his self inflating importance, has again failed to give proper information on this subject....probably because he knows nothing about how things really work...

defragmentation will indeed speed up performance and overwrite some areas of your HDD...but not all...even if you defragment and then completely fill up your drive with data, there will still be possible areas where past data is accessible (even by free programs)...temp files, page files, etc....

about the only thing he has gotten right is that it is 'expensive' to truly retrieve data (and even getting that 'straight' answer was hard)....

for the truly worried I suggest totally wiping your HDD....nuke your HDD

When presented with all the facts, most people will choose the correct course. Many vice behaviors are unlawful; yet the law discourages few. When people learn why something is wrong, laws become unnceessary.

Some educators have begun teaching Internet Etiquette, which includes warnings against satisfying one's curiosity, as Peerless mentioned. (I think the course should be titled Internet Ethics. But alas, the teaching of Ethics in high school was dropped long ago.)

I wanted to retrieve data from an old disk once and sent it to a company. They took it, checked it, then sent it back after I told them that the data isn't worth >400€ - that would have been the price for clean-room data retrieval.

Besides: Do you know the name of the german company who does the really heavy work? Would be interesting to read up a bit about them.
 
Well it all depends on the law of the country where you live.
But in general posessing KP is illegal, no matter where you live.
The people that produce it are the worst offenders, helping to spread it makes you involved as well, and "just" having it on your computer well ..... perhaps you might get away with it in some countries......
But it sure doesn't give a healthy impression now would it ?
 
Hey All.

Not sure if anybody is checking this thread any longer, but I have some thoughts and issues to discuss along the lines of "underage nudity."

First of all, somebody mentioned previously that most files are labeled incorrectly, either in an effort to make people think they are what they aren't, or to make people think they aren't what they really are (what?). For example, my first foray into this subject came one day when I had results that included "16yo," "17yo," etc (i.e. under 18) in the title. At first, I think to myself, "why in God's name would anybody BLATANTLY ADVERTISE that these files are of underage people? This can't be real." I was very suspicious, at first thinking that the people really were of age. Afterward, I thought that the reason they were advertising "Hey, I'm illegal" to the world was because they were bait courtesy of the FBI. Anyway, I selected one, downloaded it to about 50%, then paused and previewed. The person depicted was indeed young, but COULD have been 18. Too close for comfort, thought I. So cancel, delete the temp.

Upon further research, I read that "deleting is not enough." I promptly downloaded the free program aptly titled "Eraser," which can both erase (i.e. overwrite randomly slash scrambling) both empty space of a HD, as well as erasing the Recycle Bin. I've had good results, and have considered formatting and reinstalling Windows, but recent posts have caused me to feel that it may not be worth it.

Well now, after reviewing the posts on this subject, I'm torn between those that feel that a few accidental files (which does happen to friggin' EVERYONE) are harmless and those that have gotten nailed for just that, i.e. a few accidental files, i.e. Mr. Killians.

I would be very anxious to hear anyone's and everyone's response to this, as well as welcoming suggestions as to further courses of action. I think that I've been relatively careful and responsible as to my actions (Erasing, etc). One very good piece of advice for those still wishing to download legit porn (ahem) is to be AS SPECIFIC AS POSSIBLE. Search for particular stars, studios, titles, and the like. Also, preview ASAP... if it's illicit, JUNK IT. I am not one of those people that leaves their comp on for days on end, sharing this and that. When I DL, I watch it every inch of the way.

The point is that the cops can peruse my computer for a IP address and come and get me. So you guys in the Western world that have CP, even by accident, should get busy.

Who says the pictures of nude girls are porn... the Russian girls at some of the nudie sites are the sweetest chicks on the web, pornography is when these same sweet chicks are being sexually assaulted, or abused.

In many countries girls are routinely wed in their early teens, in much of Africa a woman will be a grandmother while still in her thirties... Jesus mother was said to have been married at fifteen, even as she was with child.


So what is wrong with a younger girl putting her photographic portfolio on the net, if she wants to!!


The problem I have is that the sites, and the web servers that have pictures of **** torture and murder, some of which have been running for years, are not prosecuted.



So where the hell is the FBI, and when are the studios that produce this kind of material gonna be raided and the webmasters prosecuted!!


Recently there were forty one prosecutions levied in this country (Australia,) against persons whose only crime was that they clicked onto a website.


That website was an entrapment site, that was only up for twelve hours and had three million hits!!




The latest is that every email and every website every person has visited, is to be kept on Government sponsored information banks for one year, whats gonna stop there being massive roundups and massive arrests, of ppl whose only crime is that they like pics of nude chicks!!
 
Thank you peerless and Aaron for your input. I'll have to get around trying that nuke thing. This thing has had me so stressed out and sleepless recently. I feel like the only way to make sure things don't turn bad is to go to the authorities and tell them what happened, but I fear they won't believe me. Is there any way to anonymously ask for advice from the authorities on this matter?
