I do not know your specific rights with Rogers. It would be wrong to accept a defective phone in my opinion. Probably better specific return info on Rogers is available somewhere besides this S60 forum.
In my experience with US cell companies, the first return usually resulted in them sending me a refurb of questionable quality.
