...but now he won't. Can I sue? I would like to file a small claims file but I would like to know if I have a case. I've tried to talk to him but he is giving me the run around. His brother who is a pre law student said I don't have a case. once I let him ride the motorcycle i took all liability. Is this true? i think its BS Its been about two months. I told him you break it, you buy it right before he rode it if that makes a difference. I sure did learn my lesson. Do I have a case?

to pay half the cost of the *accident* and then make payments

There's no such thing as a pre law major. If he's planning on going into law school after college that's one thing but as of now he has not spent one day in law school.

I'm not a lawyer either though so I can't tell you for sure but it seems like you have a case. He damaged your property.
