Lovefilm/C.A.R.S

I've had the same difficulty with them over the last few days. I stopped using Love film last March as the DVRAB had a tendency not to arrive. Apart from junk mail, I hadn't heard from in ages until last week when I recieved a letter from C.A.R.S. informing me that if I didn't pay
 
If you send your last lot of rentals back with a certificate of post and cancel well before the next payment date LF would not be able to charge you with anything.

Never pay a collection agency anything unlessyou receive an invoice and agree with the payment. When you cancel keep all your email correspondance with LF.

At the end of the day, they have no proof that you owe them money.
 
Did you cancel your credit card with them? If you cancelled with them but it was never properly cancelled, wouldn't they continue to take payments from your card?

Seems strange for them to allow it to go on for over a year before finally informing you how much you owe them.
 
Funny the reply you got matches mine word for word, dont know whats happening here I have been thinking of all possible senarios this week.

I would think that they have not done themselfs any favours.

When I spoke to the arse at CARS I asked him about regulatory bodies for debt collectors and he told me one that they were members of, I have a note of it at home when I return home tonight I will PM you the details.
 
Serves you right for using these on line shysters.You would not get that kind of stunt from you local bricks & windows video shop.
 
This is so good to find out it's not just me.

I am a current subscriber of LoveFilm, originally from MovieChoices.

I tried to log onto my account to check up on my dvd list.. as soon as i logged on i got a page called debt.php saying i owed them nearly 100 quid as i owed them money from the past and had outstanding dvd's which they were charging me for. I could reduce this debt by sending the dvd's back which i did.

They had sent the last dvd on the list a day before this btw.

I contacted CARS to be told the same thing as you guys i owe cash and court is a possiblity blah blah. black is white, white is black etc

I checked my bank account and saw that the last 6 collection (as far back as i could check) were fine and i was upto date INCLUDING this current month.

The funny thing is when i returned the DVD's they sent out more from my list and the outstanding dvd's changed to them they sent out.

I phoned CARS told them, they laughed and the nice guy this time told me he delt with a few of these today and there was a pattern (of stupidity?) he said contact management at Lovefilm, and guess what lovefilm say contact CARS...I have now found out that the monrh i owe is from back in December 2004 when i was with MovieChoices.

No emails from them/lovefilm about the debt at any time yet CARS say lovefilm tried to contact me several times.. I'm with gmail and have EVERY email since november!! i smell so much brown stuff it's almost comical.. i wonder how many have paid them so far without thinking!

Because he wouldnt listen to anything I was trying to tell him and kept saying "pay up now or I will see you in court" over and over again that was his answer to every point I tried to make or question I asked him.

He also threatened that he would get some local agent to come round and give me a "consultation" whatever that is.

After I sent CARS my letter, nobody from the company even bothered to contact me, the first contact I had was a phonecall from Lovefilm and then my email from the CEO at Lovefilm.

So in my opinion, the guy (I do have his name) I spoke to is an arse thats only my opinion but I am sticking to it.
 
I received one of these letters and have now paid, but having said that I did receive at least 12 e-mails informing me that there were outstanding payments. If I'm honest i thought for a small sum they would just go away but at the same time they did send me warning and it was me that chose to ignore it. i can't think that they only send e-mails to some customers and they are an internet based company!!!
 
When you live in a small town where there is no video shop to speak of you dont have much option.


I didnt cancel my credit card but they have never taken anything from it, if they had I would have been alerted to the fact there was a problem,

There are a few things that dont quite ring true on this and neither Lovefilm or C.A.R.S are willing to talk about them.

Why did they never contact me and ask me what was happening with the DVD.

They have admited they accepted my cancelation on 26th March 2004

I have checked with the PO and its too late after a year to claim comp for missing package so whether they wait a year then start creating a fuss once its too late.

I was wondering if these debt collecters they have employed are trying to see if they can get money from people who are not willing to fight them.

In the space of a couple of days they have threatend to send a local agent to me for a consultation or take me to court and also put me onto "the bad debt register" and that will affect my credit rating he says.
 
I am not upset by Lovefilm, I thought their service was great, but let down by a poor delivery performance which they rightly or wrongly blamed the royal mail for.

I cancelled my membership for that reason and that reason alone and I thought that was that.

Whats upset me personally is the heavy handed way that CARS (only doing their job) dealt with the situation it was a case of act now ask questions later I think the guy I spoke to thought he could do what he wanted to get the money if you read the letter (standard letter) it does try to infer that in its looks and wording.
 
Keep hold of the certificate of post and all correspondence emails between you and Lovefilm regarding the cancellation of their service.

If they confirmed you cancelled your subscription and you have the email they will not have a leg to stand on.

And if LF informed you, your subscription would only be cancelled once they received your last rentals, ask them why they failed to contact you when they did not receive it back.

I would also send all my correspondance emails between you and LF to the collection agency. Personally I would not pay them a penny as the error is clearly from them, also they fact that they failed to take money from your credit card confirms they were aware you cancelled.
