ok so me and another girl and her son moved in together... we both signed the same lease... the total on the house was 850 plus... i paid 280 and she paid 570 from march until august when on aug 8th she told the landlord she was moving out.. she was out the 20th. I posted an ad on kijiji and there was another roomate in one of the 3 beedrooms by the 25th of aug. the landlord found a tenant for november and december. so since other people moved in is my original lease still intact or is it now void?
my landlord and i made an agreement when the first roomate moved out that they would advertise as all inclusive and i would keep all bills in my name and just pay the bills instead of giving them rent. (i have e-mails stating me asking to switch to paying rent and them responding with we'll get together and discuss it) they decided they didnt want to have to deal with the bills so they remained in my name.
now 6 months later the landlord is trying to tell me that i owe him like $2000 for whatever rent he hasn't gotten since the first girl moved out... because the 2 of us signed the lease we are still responsible for it...
i have already tried to take the other girl to small claims to get her half of the bill money but the system is bullshit she went on welfare and is pregnant again and since a government cheque is going into her account they can't garnish it... so basically i'll never see the money unless she gets a job but since she's pregnant it wont be for a while...
the other tenants never signed a lease of any sort at all... so is mine still valid?
i'm in ontario canada if that matters...
I was told at the courthouse if she is on welfare they will not take any money out of her account...
and isn't a virbal agreement as binding as a written one? so once we decided to change my rent to the bills my lease was then void?
