It's a federal court, so I'd assume so. At least insofar as other states' laws are constructed the same way.

edit: That's probably wrong. It probably only applies to jurisdictions subsidiary to the 1st circuit.

And it's far from a copout. I am 100% apposed to 3 trimester abortions as their is no logical reason to wait that long. But to argue that abortion should be illegal because it is tantamount to murder is being intellectually dishonest from a biological and legal sense. If you want to take a moral "high-road" on the subject due to emotion or religious belief, that is all find and dandy. I would gladly respect a person's opinion NOT to have abortion.

Honestly, the whole argue is fallacious to begin with.

While they're doing their job, yes. Anybody who exercises governmental power and authority over other people should be held accountable for their actions while acting in that capacity.
