As we exited a mini roundabout in very slow traffic (about 5mph) another driver coming from the right drove straight over it and into the back of us. There was a slight scratch on both cars, both of which rubbed away. No dents or any other damage. Our then-7-month old daughter didn't even wake up and I didn't feel the impact.
Now the driver is claiming 3 counts of whiplash (himself and 2 passengers)! It's incredulous and even with a police report which backs us up on how the incident occured (he was a couple of cars behind) and a private accident investigation report we've commissioned, the insurance company still wants to try and settle!
Do you have any examples of such crooks?!
Forgot - I 100% agree, Even though investigations have shown that whiplash is only suffered in accidents over 10mph the police can't prove fraud. In addition it's the front car that suffers from the injury more than the rear vehicle. The policeman at the scene said it was laughable when we told him about the claims but there's nothing more we can do.
Furthermore it turns out one of the passengers has been regularly seeing her GP regarding an operation she had months before the accident. Strangely enough it was a doctor about 50 miles away from where they live that diagnosed the whiplash.
This would be laughed out of court if the insurance company could be bothered.
