I guess that's where I went wrong. What I meant to say is that I think this is foreshadowing things to come.
 
They didn't, and thus, according to the 10th Amendment, it's up to the State ... which is basically what they said in their ruling, as long as it is "Narrowly defined in the law". While you may "verbally" identify yourself, they also have ruled that an officer may detain you to check things out. Thus, if you want to be detained from as reasonably needed to check you out (which could be hours or days, depending on how much of a dick you want to be), that is up to you.



BTW, I am no longer going to be posting on this thread. Not because I'm losing or sick of discussing it (I'm not), I'm just sick of seventh circle and going to add him BACK to my IL and thus, this thread will "vanish" for me. Feel free to make another if you wish to continue.
 
Yes, any piece of reasonable suspicion, which can be construed as a lot of things. What I posted as an example is reasonable suspicion. You are confusing it with probable cause. Like I said, reasonable suspicion is that a cop has reason to believe that someone has, is about to or is thinking about doing something wrong. Probable cause is a cop witnessing someone doing something wrong, or having evidence that they committed a crime or were about to commit a crime. There is a difference. A cop can stop you for any little inkling they have that they think you are doing something wrong. That is what reasonable suspicion is. A BIG difference from probable cause. You're the moron using selective quoting and arguing things that no one ever said.
 
Yup, and this 5 year old ruling pretty much reverses a 42 year old ruling on Terry. Even if the AZ case heads to SCotUS, since it got a 9 to 0 ruling last time, even with 2 new Obama appointed judges, most likely the best the anti-AZ law crowd can hope for on the "You don't have to tell a cop anything other than your name" crowd can hope for is a 7 to 2 ruling against them.

Funny how the actual new 'paperwork question' was conveniently left out of the cartoon. It's almost like the joke couldn't be made with it...
 
Considering the AZ law says that an Arizona Drivers License will suffice for "proof of citizenship", I would hope that a person driving on an AZ highway, especially one who is required to have a CDL, will have it. Thus, you will not NEED a birth certificate in this example.

All of those are being done as your choice. You can forfeit that right anytime you want in order to do something. During a Terry Stop, a police officer cannot require you do anything more than give them your name. I really hope you understand the difference.
 
I'm not the one crying about the Constitutionality of this law while at the same time demanding "Free" Health care.

The Constitution only fits your "Ideals" when its convenient. And you've shown that to be true many times on this forum.

There you go, keepin on your stupid straw man. You can forfeit any right you want to at any time you want to. The thing is, you cannot be forced to give up that right. It's your choice to buy liquor, it's your choice to buy something on Amazon (which all I do is provide my name and shipping address, I've never had to send them ID ) and it's your choice to work for the employer who demands to see more ID. The police and/or government are not forcing you to do any of those things. I'm sad that you don't know the difference.
