I am not sure that anybody here has said they want to burn the flag.
You ared missing the point. Burning the flag is, IMO, a despicable act. I odn't even see it as a valid form of protest in this country because people fail to make the connection between the burning flag and whatever is being protested.
The RIGHT to burn the flag is indicitive of the free society in which we live and as such is indespensible.
thsi si not just a question of whether or not we want people burning the flag or not. This is a question of whther the entire premise of our rights based system is faulty. The flag burning amendment does EXACTLY the same thing that an amendment bannign guns would do. It invalidates our entire system. Allow me to explain:
Our entire rights based model is essentially based on the premise that people posess natural rights. These are rights that are absolutly inviolate. Our forefathers roecognised these rights by enshringing them in the Bill of Rights. One of those rights is the right of free expression. Under our current system, this is a right granted by god just for the fact you are born. Everybody has this right, and it cannot be modified by man.
An amendment to ban flag burning throws that out the window. As soon as you put such an amendment in the constitution, you are essentially switching to a soveirgn rights system, where only the governement has true rights,and they "grant" right to the people as they please (and a right that is "granted" is no right at all).
Passage of this amendment will throw hundreRAB of years of judicial precedent out the window. The courts have consistently ruled that the bill of rights is not modifiable because the rights enshrined there are not created or granted by men, therefore they cannot be modified by men. If you start adding amendments that specifically modify the bill of rights, that all goes away.
The true test of a free society is NOT in allowing people to do things that please you, it is allowing people to do things that you find extremely objectionable.
If you are not willing to fight for the freedom of the gay guy down the street to get married, or the protester who wants to burn the flag, or the KKK nutjobs that want to hold a parade, what makes you think that you deserve any freedoms? What makes their behavior that you find objectionable any difference than your behavior that others find objectionable?
Personally, I find a lot of your posts objectionable (and stupid). That does not mean that I should be able to shut you up. Quite the contrary. I would stand with you against any attempt by anybody to shut you up because while I think you are a stupid jackass, you have a right to express your opinions and to be heard.
I actually believe in rights and freedom, and that includes the rights and freedoms of those who I disagree with. You on the other hand only seem to believe that those who agree with you should have rights.
