You should be bargaining with the body shop to pay the extra rental. It's their fault your vehicle was in the shop so long, not the insurance company's. If they wont pay, you may be SOL. It'll probably cost you more than it's worth to take the insurance company to court.

First of all, I hope your friend is okay. As far as rates increasing, that's always a risk for a chargeable collision. Depending on your claims history, your policy and the company, they may increase. If you have a policy that gives clean record discounts, you will probably lose that.
