Would Tmobile let me get a phone if I i already sent a phone back for cancellation?

I recently sent back a phone to tmobile for a cancellation. I returned it back before the 14 days were up. Its also still in the process and im waiting for the rest of my refund they owe me. Its a long story how my dad made me send it back because of the bill, but now he changed his mind or whatever and also because im working.

I also want to know if i could get a tmobile phone and just put tmobile service on it because my cousin has a brand new, never open mytouch4g.
