Will she go to jail even if it's her first offense on her record?

My friend got caught shoplifting at Kohl's. It was her first time and they banned her from all Kohl's stores (obviously) and now she has a PTA for Friday. Will she go to jail if it was her first thing ever on her record? She's 22 years old.
 
it depends. If what she stole was under $500 I think, then she won't go to jail, it will be considered "retail fraud."
 
No. I have never heard of anyone going to jail on their 1st petty theft offense.They will more than likely make her go to a diversion class and/or community service. She will probably be put on a 1 year conditional sentence in which she cannot get into any trouble or re-offend during that time and complete the diversion class and pay any fines due. It will more than likely be dismissed after the conditional sentence is up. She may have to pay restitution and Khols will want many times the amount the item was worth.

My son stole an $8.00 shirt from Khols when he was a kid. Khols sent me a bill for $350.00. I sent them a check for $8.00 (the amount of the shirt) and a note to "kiss my ass". I never heard from them again. They should have put my son to work instead. Well I did and he has since grown up to be an honest, productive successful adult.
 
it depends on what it was she was trying to shoplift. If it was something relatively cheap, then her punishment will be far less than if she were trying to shoplift, something that were $500.

An ex boyfriend of mine was caught shoplifting a magazine and they found a pocket knife on him that he had shoplifted a few weeks earlier. They had been keeping an eye out for him due to seeing him on security cameras. He got probation and community service.
 
No one can say for certain but its highly unlikely. Try this website forum they may know
