Will my husband go to jail if he fails to settle the checks he issued as guarantee

from the money he borrowed? my husband borrowed some money from people to sustain his new business venture, unfortunately the business did not kick off and went bankrupt, one investor filed a case and the court recommended that the respondent be indicted for estafa and 2 counts of violation of bp22, we also lost everything because of this business venture and and we practically have nothing on hand, please advice what are our possible options, the amount involve is 700,000.00php.estafa case and 2 checks amounting to 21,000.00 for interest for bp22 case what if we can only pay 3,000.00-5,000.00 monthly? is this acceptable? i would really appreciate if someone can tell us our options regarding our problem. thank you
just an additional info, we are residing in the Philippines and we did not file for bankruptcy. thank you.
 
Since you filed for bankruptcy these owed bills should be declared under the bankruptcy laws. The payment amount monthly after bankruptcy court proceedings will be based on your income. In other words they can't make you pay what you don't have. They can't leave you destitute.
