Why wasn't I taken to Jail?

I got a DUI when I blew a .041 in MN. but they didnt arrest me or take me to jail. The officer also did not give me the option to blow. Why didnt he follow the correct procedure? and can I use this to get out of it?
 
So you're under 21 and had alcohol in you your Bac is below the legal limit so you must have been under 21. In that case any alcohol even .011 would automatically get you in trouble.

Sorry but if you're a minor and show any alcohol in your system below the legal limit or not it's automatic... no way out.
 
Your story makes no sense.

You blew a .041 but the officer did not give you the option to blow?
What happened after the traffic stop? You drove away? You were picked up? You walked?


Come on....some details would have been great.



I'm going to guess you're under 21
That, or you simply were charged with something other than a DUI.
