Why isn't this doctor liable?

Most of us have heard about the woman a few years ago that spilled hot coffee, that she purchased from McDonald's, in her lap, suid and was awarded 4 million dollars. This lady accidentally spilled coffee on herself, but how is McDonald's liable for that. And 4 million? For what?

Now if someone can get 4 million dollars for being clumsey, why wouldn't a doctor be liable for severing someone's nerves during, what was told to be, a simple procedure? That happened to me.

I went to a plastic surgeon while living in California, to ask about removing some fatty tissue under my lower lip (between the lip and the chin). After examining the area, he said he could flatten the area in what he said, was a simple procedure. I paid the money in advance (as required) and he performed the local procedure on me. I was given shots inside my mouth down towards the chin area, to deaden the area. He performed his procedure from the inside of my mouth, clipped some tissue out and stitched it back up.

First of all, not only did the procedure not change anything (it's more fatty looking than before), but he severed my nerves, which has left me with no feeling in my lower lip, down to my chin. Constant pins & needles feeling, the same feeling you have when you're shot with novacane. I can't feel a thing now. I have to use a straw to drink anything, or else I drool, because I cant feel anything. It feels like I have a lump in my mouth 27/7. For over a year after the procedure I tried to reach the doctor, but always got his office manager who never passed the message on to him (so I was told) and I never spoke directly to him ever again. I sent emails and phone messages to no avail.

Finally, I filed a complaint with the CA Medical Board. Sent 19 pages of documented information, pictures of before & after, medical records that were obviously altered, and a certified letter from another plastic surgeon that varified the nerves were cut during the procedure. This went on for more than a year with the medical board, only to receive a letter stating that they find no fault with the doctor.

NO FAULT? He cut my nerves and I have to live the rest of my life without feeling, drooling, swollen area and like if I have novacane 24 hrs a day. And I'm supposed to just be okay with that? Am I missing something here? I wasn't out for any compensation, hearing from the doctor, personally, would have been an accomplishment, but I expected something in return for my numerous calls and emails.

I even called a few attorneys, who passed on taking it as a case. Why?? I just wanted some kind of satisfaction and got nothing, nothing at all.

So I ask again, how can someone get 4 million for being a clumsy ***, and I have to live with damage to my face because of the fault of the doctor and I can't do anything about it? WTF is that?
