Why isn't Eric Holder arguing that the Arizona law is facially discriminatory thus...

...unconstitutional? If this law is as racist as Clinton, Holder, Obama, et al say it is, why not sue on those grounds? Why use the supremacy clause?

Don't get me wrong, they don't have a case either way...

I heard a great point earlier:

If they are suing Arizona for supposedly writing laws contrary to Federal laws, why haven't they sued every sanctuary city who have laws that CLEARLY violate Federal laws?
 
Don't have a case? Only 100 years of precedence on the supremacy issue. Only a similar California law thrown out. Only a similar Illinois law thrown out. Both on the supremacy issue. Fact is under the Constitution Arizona does not have the power to enact or enforce their own immigration laws. It does not matter if the Arizona law is word for word the same as the federal law. The Arizona law clearly violates the supremacy clause. The federal lawsuit will be upheld, no question.
 
I think Holder makes that argument in an associated brief, just not in the main lawsuit. Apparently somebody at DOJ finally read the Arizona law and discovered that what Holder and Obama had been saying were lies.
 
Because the law isn't discriminatory or illegal. The law isn't giving police the power to arbitrarily check the immigration status of citizens randomly. Law enforcement can ask and check the status of a persons immigration status that they come into contact with as part of their duties; i.e traffic stop, or responding to a call at their home.
 
How exactly is this law discriminatory or illegal? All U.S. Citizens at one time or another have been asked to show their Driver's License or ID. It is a practiced technique of the Police to ask people for ID if they are in a neighborhood or place that it appears they should not be. That does not fall under probable cause but is a necessary evil in this day and age. I am kind of tired of the lack of common sense giving way to sensitivity in this country! This is the only country I know of that bends over backwards to make others feel welcome at the expense of their own citizens.
