Why is credit checking, if you're a business looking for employees, legal?

I live in America, and some things here are as* backwards. I haven't had personal experience with this, but a close friend of mine has.

What right does a business have to check your credit and not hire you based on that? Your personal life is no one's business, and that includes your finances. How are you supposed to pay off your bills, or get a good job, to better your credit if they won't hire you because of bad credit?

My friend was basically told, "We don't want to put drugs in front of a drug addict.", accusing him that he would have stolen from the workplace. His WIFE ruined his credit, not him.

I don't get how this practice is legal. Can someone explain how this all started?
 
I agree that it is generally a foolish practice.

People can have bad credit for many reasons that are not related to your performance as an employee.

for example someone who loses a job may not be able to apy bills no that they have little or no income.

As a result that person's credit is destroyed.

That does not mean that this person will be a bad employee.
 
The practice is perfectly fair. Every company has a right to know who they are going to hire as it is in the best interest of the company. It's okay if somebody does not want to disclose certain information, in that case they just won't get the job.

Your friend does not have a right to have a job. Also, just because his wife is the one who damaged his credit does not matter. They are now legally a partnership and whatever one does affects the other.
