Why does apple claim to have a 10 hour battery in the new macbook pro?

That's 10 hours of average use, such as typing up a document or a spreadsheet in a well lit room.

If you're only getting 5 hours, the odds are that are hitting your wifi heavily or are doing things like watching movies or listening to music with the volume turned right up and the screen brightness turned right up.

If you are connecting to a low powered wireless network with a weak signal, or a lot of interference then it will hit your battery life.
