Of course. By law they can only state the dates of service, and whether or not they are elligible for rehire.

Anything more than that and they could get sued. You can ask anything you want, but the companies I have worked for will only give out what is allowed by law.
 
...for a background check? Is there a legal reason for this? I'm talking about when HR does a background check and asks why the old employee was terminated. Why do some companies have a policy of not giving out details, just a vague category like performance issues? Is there a way to get around this, like asking them to confirm or deny the reason that was given by the new hire?
