why do people believe paying income tax is beneficial to us?

I do believe as do many economist will agree, that the US would benefit greatly by abolishing any notion of an income tax and ens- tating a 10% sales tax nation wide. This would help stop tax evaders from evading and lower the tax burden on those who faithfully pay thier taxes.

Why is it so many are willing to advise people who ask questions about not paying income tax to pay it? Are we such cowards that we must push off our own fears onto others. I am not going to be so bold as to answer this question either way for anyone as this is a personal choice and I believe we should approach it from that view point rather than telling people what they should do, which is technically practicing law without a license, and could incur a severe penalty just as so many are worried about incuring retaliation from the IRS for not paying income tax. So here is what I would do. First I would recommend doing your homework and research for yourself and not relying on what any old idiot on the internet is going to tell you, including myself. I have decided for myself whether making us pay income tax is legal or not and, however much I would like to give you my conclusions, that would be unfair to you, as I have done my research, and base my conclusions on this research. If I were to just tell you what I concluded it could cause yopu to possibly make rash decisions and possibly cause you countless hours of stress and discomfert which

[G]ross income means all income from whatever source derived.


"All income from whatever source derived" does NOT mean "all income from whatever source derived."

Preposterous! Bunk! B.S.! Illogical! So you think emphatically as you read that sentence above... Nod your head in agreement. I know that is what I would think if I read such a sentence.

However, stay with me and I will prove the statement.

The phrase is found in IRC section 61(a):

Internal Revenue Code
Sec. 61. Gross income defined

(a) General definition
Except as otherwise provided in this subtitle, gross income means all income from whatever source derived, including (but not limited to) the following items:


"Except as otherwise provided" clearly informs us that there are situations where the statement "All income from whatever source derived" is false. "Except as otherwise provided" negates or erases the word "All".

This led me to believe that somewhere in us tax code( named code for a reason, because it is puposely set up so that the average person cannot decipher it) was a listing or explanation of what was outside the realm of "all income from whatever source derived" if you track this you will find yourself, if you are honest with yourself, and a bit of a detective, with a whole new set of rules by which to define "Taxable Income". Armed with these facts you will then be able to determine the answer to the question "do I have to pay income tax"

I have also noted this,

In the 1040 instruction booklet it states In the Income section, under Foreign-source income,
you must report unearned income such as interest, dividends, and pensions from sources outside the United States unless exempt by tax law or treaty. You must also report earned income such as wages and tips from outside the united states.

And my question is this, why is there no such statement in the 1040 booklet with regards to income earned domestically? Seemed a bit odd to me, doesn’t it to you? Look this up for yourself, and don’t take my word for it.

Phew. You scared me there a minute. Based on the original question, it appeared you were suggesting that we shouldn't pay taxes at all. That is ludicrous. That said, I could get on board with your sales tax suggestion, except for three things:

1. It would have to be altered for the poor. They can't afford food and clothing as it is without taxing everything. The current tax code protects their income. The same would have to be true for a sales tax, or these people would starve.

2. Rich people would get around a sales tax even easier than an income tax. They can afford to purchase whatever they need OUTSIDE the U.S. Then the government doesn't get anything at all. You know how much it would cost to police this? LOL! More than it costs to police the income tax, that is for sure.

3. What happens in an economic crisis? Sales tax would be just as easily susceptible to a crisis like we are in now than income- likely more so.

Solve those problems, and I'm totally on board.
