no, because we as a society have hitherto defined marriage as a union between man and woman. we can and should change that, but no part of the 14th amendment furnishes expansion of this concept. It's a technical difference in the same way that, prior to bans on third trimester abortions, terminating a child once it is birthed isn't abortion, it's murder.
