"Life liberty or property", where in there does it state anything about a state instituted status change?

It's also neither cruel nor unusual to PUNISH prisoners for the crimes they've committed, instead of locking them up in a resort.
 
And yes, POWs are entitled to a hearing before a military tribunal to determine whether they're lawful corabatants and entitled to the protections of the geneva conventions. But it's not a criminal trial.

Keep blacks out of schools if your state allows you to.
Execute innocent people if you state allows you to.
Execute foreigners without regard to international treaty if your state allows you to.
 
I don't think the constitution furnishes gay marriage but I also think we should move in that direction [pro] because it's...the right thing to do? and there's no compelling reason not to.
