do we try each and every insurgent captured? if so, what crime have they committed other than non-uniformed corabat?
if a SS private attempted to surrender to a group of US soldiers in WW2 with a grenade in his pocket, was that an act of terror? essentially, can you commit acts of terror in war?
 
Constitutional Conservatives support less government and more freedom.

You can smoke weed if your state allows you to.
Women can get an abortion if their state permits it.
You can marry someone of the same sex if the state you live in thinks it's alright.

There is a legitimate states rights argument to be had regarding marijuana and other drugs, but it's often used as a basis for wanting to overturn Roe v. Wade or deny homosexuals [what should be] the 14th Amendment protected right to marry.

the 10th ammendment allows implied powers and is a scaling back of the articles of confederation which only allowed specified powers.

Why do conservatives hate the ennumerated power "To coin Money, regulate the Value thereof, and of foreign Coin"
 
Self identified "constitutional conservatives" generally aren't much different from neo-cons. They're certainly not Libertarians.

It's kind of like how self identified Tea Partiers are really just Religious Right nutjobs.

Each individual municipality can decide if the invaders are actually invaders or welcome them if desired. A simple vote is all that is required.
 
Most americans don't have fully developed political/philosophical viewpoints, just immediate emotionally based concerns that the dualistic political system easily takes advantage of.
 
Why would they be tried? The military is not a fucking police force. They aren't arresting criminals. They're killing and capturing enemies. If you don't understand that difference, please just exit this discussion.
 
it's an outdated concept that worked in the horse and buggy days but is no longer relevant.

if it's that important, we might as well just split into 50 different countries
