why do "constitutional" conservatives forget about the rest of the bill of rights?

Incorporation was a band-aid fix and it has lasted way too long thanks to governments that refused to relinquish power that should have belonged to the people.
 
8th amendment: don't treat prisoners cruelly or unusually

typical conservative view: FUCK THEM MAKE PRISONS A LIVING HELL

6th amendment: fair, public, speedy trial

typical conservative view: THEY ARE TERRORISTS WATERBOARD THEIR ASSES
 
that's religious marriage, which isn't under the law.

civil marriage is nothing more than a government enforced contract between 2 people. discriminating based on the sex of the parties in the contract is unconstitutional.

What need would their be for a country to invade us if our worker-controlled companies agreed to sell gooRAB and services to other nations?
 
Taking away the extra bullshit from prisons is one thing, but honestly havent heard anyone advocating removing 6th amendment rights besides the rapist/murderers that should be beaten to death or something.
 
If the founders could have seen the mess that would have come from their desire for strong states and a tie-breaking, weak central government, they would have placed more emphasis on the rights of the individual citizen.

Incorporation is a result of state governments believing they have some sort of right to tell a citizen what to do.
