Who's responsible to pay for the damages of the car?

A loans his car to B.

B drives A's car.

B & C get into an accident. It's 100% C's fault.

A cannot track down C. C flees. C is like, nowhere to be found. C gave faulty contact information.
You can't find C!


So A decides to sue B for the damages to the car since B was driving it.

Who wins the case? A or B?
 
B as he was not at fault, and A should have been insured, if A was insured, B would probally have to pay excess.
 
The driver is responsible for damages in the absence of another guilty party at fault. Since "C" is gone with no evidence, "B" is responsible

I just had this EXACT same thing happen in January. I won, because 'A' willingly loaned me (an insured and licensed driver), his vehicle. C did disappear, he was piss-drunk. It really depends on your attorneys and the state you live in. Oh, and wheteher the judge is on her rag that day.
