...misconduct/discrimination & miscarriage of Justice? Settlement Conference set for 9/29/2009 09:30 AM in Judge's Chambers Suite 9E (MPLS) before Magistrate Judge Susan R. Nelson. Signed by Magistrate Judge Susan R. Nelson on 08/12/2009. (MMP)

Mr. Harmon (my retained attorney), Mr. A. Goins (not retained attorney) my support Diane Devon & Nicole Rosenbloom, GNC INC Legal representative, & myself Nicklos, R, Rosenbloom. Were present.

We were separated from GNC Inc & placed in different room.

The Magistrate introduced her self to us & in the same breath began the Settlement Conference by saying-

1 That her flight was delayed coming back from London.& the hastle of getting back.

2. The Magistrate & Mr. Goins commented on how they had to rearrange their schedulers to fit time in for the settlement conference.

3.She then went on to say how she's been doing her job for a long time & how good at her job she is.

4.Then went on to say how the court views cases. How if there's no visual pain, broken limb, missing arm, how bad the economy is. That the jury is less likely to award big settlements.

5.In addition the Magistrate said she settles cases to keep them from having to go to federal Cort and how the cost and fees can be $50,000.00.

6.the Magistrate also aded that taken the case to court would be like gambling & you never know the out come.

-The Magistrate then begin to ask me my employment history & loss wages.
The Magistrate commented on how my $700,000.00 was not going to be granted.

I told the magistrate I was terminated in 2005 & I haven't been full time since.& according to my taxes My total loss since 2005 & 2008 was $75,000,00. I believe I'm entitled three times loss wages and damages.

-The magistrate said the Judge & Jury only count two years back on lost wages
As she went on added that I need to move on and put this issue behind me. I need ot get on with my life.

-The Magistrate then noted how she could settle the case at a range of 25 to 150 thousand.
The Magistrate then left to verify if the attorney for GNC INC didn't have a cap on the amount they would settle.

While The magistrate was out of the room Mr. Goins again spoke of his tragic cases (when the magistrate was out of the room) He mentioned:

Misconduct, Legal Malpractice, Bulling, Harassment, fraud, and ineffective counsel

1.How a case of his involved a guy on the job told a “white women she had nice big tits”.

2. How another case involved a factory worker driving a (white) fork lift & asked to a female worker ’ you should ride my white pony” & then asked if I knew what that meant. I answer ‘yes a appropriate sexual innuendo“..

3.Mr Goins reminded me of the cases he & Mr. Harmon shared at our meetings before the conference Settlement

4.The Lawyer with folded arms demanding $3,000.000.00& how the Judge threw everything out (evidence) because the Legal representative didn't have his “shit together”.

5.About the incident that involved (my cousin) Stephen Porter being humiliated and abused by cops. During a police raid in north Minneapolis few ears back. When the Police stuck a stick up the mans “ass” and no payments were made

Mr. Goins & Mr. Harmon continued with negative connotations and said the jury wouldn't award a big settlement because of the economy and no none want any one to have more money than them.

Plus the jury wouldn't have any people of color on the panel nor would they be from Minneapolis, gay & that a lawyer can have anyone removed from the jury if they don't like them. Regardless. For their own personal reasons (during jury selection Lawyers can discriminate). They then went on to tell how they have a term called “sandpapering the Jury smooth them over to get them on your side.

The Magistrate came back into the room mentioned that the Legal representative for GNC Inc., had a cap. She then asked for Mr. Harmon & Mr. Goins To come meet with her, & excused Ms Devon, Ms. Rosenbloom & Myself to grab a sandwich from the café down stairs ad to hurry back. So we did. The Magistrate, Mr. Harmon,& Mr. Goins returned shortly after.

The Magistrate said GNC claims I stole $400.00 and thats the reason I was terminated.
I explained to the Magistrate that


1.GNC INC tried to use the same tactics when I received unemployment GNC INC appealed the decision & the ruling stayed in my favor.

2. I also mention how GNC terminated me & transferred Mr. Henry

The Magistrate then added that I never filed for lost wages and retaliation. So I was unable to claim retaliation & loss wages as part of my settlement.

3.I informed the Magistrate I had field for retaliation & loss wages after I was terminated & informed MDCR of the action GNC Inc had taken against me.

4.The Magistrate asked me who was my Lawyer at the time. I said M
