I don't know the proper terminology to ask this question, but basically the situation is this: my husband has been convicted of domestic violence in the criminal court and is serving his sentence. I have a hearing in civil court to get an order of protection for when he gets out of jail. Since he is already convicted in criminal court, will it be harder or easier to get a finding of domestic violence in the civil court?
Which court has harder burden of proof?
