When you are innocently arrested do you get any type of compensation for jail time?

I'm watching Forensic Files right now on Tru TV and this man was arrested for rape and burglary and got 70 years in prison. He served 5 years before science proved he was innocent.
He said that all the prison said was that they were sorry. I would imagine they would do something more than that?
 
What would be the implications if it were a death penalty case,the sentence is carried out and later the person was found innocent of the crime? What then?How much is one life worth?
 
The person could file a lawsuit, but if you're arrested in some jurisdictions, you have to pay the county, even if you're innocent, for their having to house you as an inmate.
 
You CAN get compensation. In my law class we learned about many people who got money for being in jail when they were innocent.
 
Res Judicata is right. Hopefully, though, the prison or a program would help with getting you back on your feet such as job placement and housing, etc.
 
Because you are convicted of a jury by your peers, you are not entitled to compensation by default, but you can bring civil litgation against the government.
 
thats really all they can do is say sorry it sucks for person innocently accused

sometimes ppl get little money for compensation, but usually its just sorry and they throw u onto streets
 
You're compensation is being let out, could you imagine if they were too ashamed to admit they were wrong and kept you in jail for that long?! that would be quite horrible.
 
If you can show the police or prosecution was deliberately in error, hiding exculpatory evidence, or somehow knew you were truly innocent, but still pursued the arrest or conviction...then yes, you may be entitled to compensation for prosecutorial or police misconduct.

Other than that, the state is not responsible for the errors of a jury.
