...gets applied in accident? I always hear about people getting in accidents and either getting slapped with an insult in injury reckless driving citation OR getting nothing even if they were grossly wrong.
So I ask, is this citation purely discretionary or are there set guidelines?
I've heard of instances where both parties aren't in agreement with what happened or who was at fault and one party still gets a reckless driving citation. But then there's stories I've heard where people are morons and hit something and get no citation.
Is this all discretionary or is there a logic behind the difering stories I hear?
