Whats the legalities of replacing a garden wall with a retaining wall?

We had a 1.2m single brick wall in our backyard which has been there since the house was built 50 yrs ago, we pulled it down and replaced it with a limestone retaining wall with footings we rang a structural engineer prior and got measurements which were acceptable for a retaining wall also so got a builder in using appropriate blocks etc, the council has come out regarding a diff application and have threatened to rip it down because we haven't got approval for a wall and they have no plans of a wall ever being there, is there any way that we can get away with keeping it?? it cost a fortune to rebuild at is safer and more structurally sound than the original wall?
is it still the case you need approval even though there was a pre-existing wall?
 
I'm perplexed. Your contractor should have gotten a permit form your local building and zoning board and presented the building plan to them. Contact the contractor and ask for their permit to build the wall. If they got the permit legally, and they have insurance (keep your fingers crossed) have them help you fight the order before the zoning board. If it was done illegally, sue the company in court for the costs.
