scene: an insane woman beats another woman to death because of revenge, what would a judge say at her sentence?

"I hope that in the next remaining years of your life in incarceration, you will learn to have regret for your own actions and find sympathy for the victim's family."

After the Court is brought back into session, the defendant would be asked to rise.

The judge would talk about the pre-sentence report that was prepared by the Probation Officer. The judge would discuss some key findings in the report, and any aggravating and mitigating circumstances identified. It would sound something like this.

"Ms. ____, I have had an opportunity to review the pre-sentence report, I have listened to the sentencing arguments from both your attorney and the state's attorney, as well as the statements from the family of the victim and you have twice been given an opportunity to address this Court. Having been found guilty by a jury, it is now up to me to sentence you.

The pre-sentence report recommends a sentence of 25 years. In this state, that would mean that you would have to serve a minimum of 18 years before you would be eligible for parole. This Court has the ability to accept this recommendation or reject it and impose a different sentence. The minimum sentence available to this Court is 12.5 years in prison, the maximum is life.

In making the recommendation, the Probation Officer noted that your crime was particularly viscious. Additionally, you attempted to cover up your crime by trying to dispose of evidence. Your behaviour during and after the crime strikes me as cold, calculating and without remorse.

Although you are crying right now, I do not believe that your tears are tears for the victim or her family, but are tears for yourself as you now face the possibility of spending the rest of your life in prison.

However, the report also noted that you have no prior convictions and that your family had previously been victimised by the victim. And although I sympathise with your situation, I will not and nor will this Court condone acts of revenge. Crime and punishment is about justice, not revenge and we cannot allow people to take the law into their own hands."

(after a brief pause)

"I accept the recommendation of the Probation Department and sentence you to custody of the _______ (state) Department of Corrections for a term of 25 years.

You have the right to appeal this sentence, but your rights are limited and you must file a notice of your intent to appeal within ____ (amount of time) after sentencing. Your attorney can help you with this filing."

"You're a very naughty girl.
Do 100 lines 'I must not brutally murder people', and report to my office with them first thing tomorrow morning. If you start making a habit of this, I will have no choice but to inform your parents"
