What makes a cell phone need data plan

Hi I was wondering what makes a phone have to have a data plan. I purchased the chocolate touch which does not need a data plan but others i looked at do. Also what makes a phone an advance device. I signed up for insurance and i didnt need the 7.99 advance device insurance.

The phone must be a 'smartphone'. Any blackberry, android, palm, or windows mobile device, basically.

Also select "smart dumb phones" will require a data plan of $9.99 or higher...like the Rogue.
