What is the law with regard to whether or not a wife can keep her maiden name,

or whether he can take her name? or whether the children can take the name of the mother, or even, one child takes on parent's name, and another child takes the other?
 
there is no law against this. I think it would be very bad for the children to have be brothers/sisters/brother & sister with different last names. I wish you were more specific with this question, as in what your intentions are.
 
Presumptively courts see it as the last name the custodial parent gave the child, is in the best interest of the child. However, that presumption is rebuttable through a preponderance of evidence showing why it is in the best interest of the child to have the father's last name.

Usually a suit for change of name/minor child, can be successful when the petitioner is the father. Courts tend to view a child having the fathers last name, who plays or wants to play an active role in the child's life, as in the best interest of the child.

Preponderance is simply putting forth evidence just enough to outweigh the case against what you're seeking.

As far as who takes what name in a marriage, that's to be decided by the marrying parties.
 
theres no law u can name ur child whatever name u want.. a name is just a name.. there are no laws about a wife "having to change her name" or spouse ect.. its ur choice..
 
When getting married it is the choice of the wife whether she wants to change it or not-though normally most switch to their husbands last name. As for kids, it doesn't matter whose name they got as long as you both decided on it. Though if sibling end up with different last name they may want a reason later on and 'just cause with felt like it' would be a bad answer haha.
