What is the downside of jailbreaking an iPhone 3GS 4.1 software?

I have a jailbroken iPod touch and it's a 3 g 16 g model I don't see me taking it to apple anytime soon but I also have an iPhone 3gs 16g also running on 4.1 software. I was curious If I did jailbreak this iPhone and for somereason had to take it into apple would they be able to tell If it was jailbroken? Or would I be able to restore to factory settings and be fine? Thanks
