What is legal to tell a job applicant when they are filling out an application?

For example, is it legal to tell the person that we are not hiring, etc.? I am a receptionist and I DO NOT work in HR and never have. However, HR bums just about anything and everything off on someone else for them to do. So, I have the task of giving applications to people who request them. I am often asked what positions we have, if we are hiring, what positions we are hiring for and I've even been told that they "heard" we are hiring (which was untrue as far as I knew). I have never been instructed by HR in any way as to what I could and could not say to an applicant. I simply turn the completed application in to the HR dept. and that's it. I never volunteer any information to an applicant unless I am asked point blank by them. In that case, I am honest with them. Why get someone's hopes up who is looking for a job by feeding them some b.s.?

BTW, I live in KS - I'm sure the laws vary from state to state.

Asking HR for help/guidance is NOT an option - believe me.
A co-worker of mine (who is NOT in HR either) says that because of unemployment law and the requirement that people collecting unemployment being required to look for a job/fill out applications, etc., we cannot turn anyone away who wants to fill out an application. I know other businesses that will NOT accept applications if they are not hiring OR that will only let you fill out an application for open positions. So, I am not sure what the "rule" is.
