are only on a month to month lease. We have always been on a month to month lease, but lately our living situation has turned hostile and he is trying to over charge me for bills etc. He wanted to move out so I told him ok I will find a replacement. He refused to let me show his room when he wasnt home and would not cooperate with this option. I finally found a roommate and told him I want to give my 30 day notice on the first of the month (10 days from this date, so 40 day notice total) He said he is not giving his notice and there is nothing I can do until he does. I want to move desperately, but he is again not cooperating and I dont want to be held liable after my 30 day notice. The leasing office said we have to give our notice at the same time, what should I do?

Up until you said you have to give your thirty days notice at the same time I was ready to give you advice ~ I had a roomate I wanted to move and I gave my 30 days notice and was off the agreement and was not liable for anything after the date given.

I would use the internet to research law in your state regarding this situations to get your legal options....

I'm sorry about your situation
