Last yr I was in a car accident with my infant son. I had whiplash and was in pain for months. I decided to consult with a lawyer to help me with medical fees and things. The first attorney I went to go see, the paralegal had me signing papers agreeing for them to represent me before I new what was going on.
Since then she/they haven't done anything. My car was damaged, I took it to the repair shop the other insurance told me to bring it too, and it ended up with other issues. The back door and passenger door didn't close properly, one of the air vents were broken. I took it back to them numorous times and the idiots kept saying nothing was wrong (they did fix the back door). I told my lawyer/paralegel (I'll call her Pam) and she was like "oh um ah' and told me to bring it there, and get a quote to fix the issues that were wrong from another dealership. I did that, driving here there and everywhere, only for her to be confused when I gave HER the quotes, and she didn't even do anything with them.
Then I call every once and a while to see how its going. She always acts confused and gives me a semi answer thinking that will satisfy me. I am on medicare for being disable for over 3 years. I tell her this numorous times. I start getting letters from the insurance and the hospital wanting me to give them info. I drive 45 min to the lawyer to give to them, shes confused. The hospital ends up telling me they have to file with the insurance company or they won't get paid. Pam was waiting on a form from my insurance saying they didn't pay, but then they did pay.
We finally get a "offer" which is laughable. 2300, when medical was close to 4000. I say no. I asked her again to keep me informed about whats going on. Amonth later I call back, and after "um, ah, ohhh" She tells me they got another offer 2 weeks ago, for 2500. So I say "NO", then she tells me "what will you settle for, to take home" And I said, since they offered 2500, I'll take that, as my money. I called her a few weeks later and leave a message asking her to get things moving faster (its been over a yr) and tell the adjuster that I will settle min for this amount only, and if we go to court I'll be asking for more" I don't hear from her, so I wait a week, and once she's on the I ask "did you get my message" and shes like "um, yes" then tells me how Medicare has a new law that Pres Obama made saying if you have a settlement over 1000$ then you can't get medicare anymore. I called Medicare, and asked them. The lady spoke with her superviser and then told me shes never heard of it. I google it, to see if its new. And NOTHING. So I'm guessing PAM lied to me. I tried calling and talking to the lawyer, but Pam keeps answering the phone. I am mad, this is baloney,and I know they are going to try charging me more money.
Pam just called, must have seen I called and tried to talk to my lawyer. She told me he was the one who told her about this new law. So strange....
Am I still going to have to pay this lawyer for "services". He's out of the office till next week.
