proceedings? I am the plaintiff in a partition suit. Preliminary decree was passed in my favour. Defendant's appeal was dismissed for default in high court. Final decree proceedings are currently going on. The honourable judge passed an order rejecting all pending application of the defendants. The honourable judge has now placed the matter for final argument and passing order. The defendants have now filed a writ petition against the above order.(under section 115 of CPC)

What is the procedure in the high court regarding this writ petition. It is still at pre - admission stage. What are the chances of a stay being granted in the lower court before this matter comes for hearing. Can it be dismissed at this stage itself considering that the appeal of the defendant after preliminary decree has been dismissed by the high court and final decree has not been passed as yet.
