Is it legal to use this and access the internet without the data plan? If it is ok, is it a good idea to call Tmobile to find out why mine doesnt work? thanks

It might work, but they might charge you at a higher price on your next bill.

Why would you want a blackberry without a data plan? Wouldn't that make it just a phone?

I've been able to successfuly use wap.voicestream.com on my 7290, after i spent few hours reflashing it with different OS's and finally using flash from Orange(cell provider in Europe). Using Opera Mini for websites and Yak-On! for AIM.
