I was on probation for domestic violence case a year ago, My fiance got scared for me showing up at her college after an argument and the probation officer call me and told me to meet with him 5 days after, I did show up after the five days and i was arrested for suspicious behavior, is weird they never came to my home. I went to see the judge after 6 days in jail, the judge let me go becuase there was no further charges or complaints so far, my fiance never press charges. The problem was that somehow I.N.S got involve on my case and they took me from jail. Prior to completion of proceedings I was granted voluntary departure They gave me 14 days to leave. They question me for 3 previous marriages and one in particular where my ex wife told INS the marriage was fake, we never reopen the case because she dissapear. She sayed that i was giving her money at the interview. Si i did told the judge that her drugs behavior make her say that. I did have a previous domestic violence case back on 2005. both cases of D.V ended up on misdemeanors and i did 30 days com/service with only 3 days real jail. One says that i throw a cell phone 20 feet away from my ex wife an even when my ex say that she wasn't sure if it was an accident, there was an anger problem. The second one i did pull my ex girlfriend sweater and her friend call the cops. The judge told me that with the V.D my fiance can married me and file for me. One after my departure my fiance and I got married. She returned to California with 7 months and one week pregnant. We are going to submit the I-130 next week on aug, 20. Doctors have told her since april that she is facing a high risk pregnancy due to a problem on the baby kidneys.
They already have choose an specific hospital at Standford for her due to the situation and the baby will have to stay for one week on Intensive Care, There is also issues with the heart, they don't know if treatment will be enough. My wife is devastated and me depress to the point i am home all the time in Peru. Lawyers didn't believe i was going to get V.D base on my situation but i got it. My wife will be forced to walk away from her family and carreer by coming back to peru after the baby is better or in treatment, shealready start attending a phicologyst. So do we have to include a hardship already or the baby situation or wait till i can submit the 601?. Should i have it ready to submit the 601 the same day i am at the interview or needs to be submited from the U.S.?....How long are we facing?....Thanks for reading this. I got there as a tourist back on 2000. Should I on the I-130 put removal or juditial proceedings?....On 2005 i got a letter saying that i got to leave and not petition shall be approved but they never came to the house. I was also arrested on 2007 for the second D.V and I went back home ok. I will be a daddy soon.

I forgot to explain that she didn't prove it that the marriage was fake, she just accused me. She is being arrested for drugs before also.

Also the first time i did one year of classes for D.V and the second time i did 27 out of the 52 and i did complete the 27 days of C.Service.

Please ...this question needs to be answer by lawyers, I did my researches and I know i got lucky with V.D. If the fake marriage was real then that will be call fraud and that is 3 years in Jail, I will be ask those questions but is ok, two of my ex wifes still friends with me.
