Verizon Replacement Phone Policies?

I have an LG Ally that has been working fine until it fell out of my hand and got a small crack near the top! Things like this bother me, so I kinda hate looking at the phone now. I have insurance and all but my parents don't want to pay the 90$ deductible on the phone, and I don't want them to with it being close to christmas and all. We figured it would be best to call the verizon customer service and get a replacement free of charge. Everything worked beautifully until the rep said we would have to mail back the old device to verizon. This is either a new policy or one that isn't strongly enforced because when i got a phone replacement on my Krzr I did not have to mail my device back in. So my questions are the following.

1. Do I really have to send the phone back?
2. If I do have to send the phone back to Verizon, what would be the penalties for the damage?

I would hate for my parents to have to pay full retail price for my phone. So am I freaking out for nothing, or should I take the new device back when it gets here?

It is a 90$ deductible. The Ally is considered an advanced device by Asurion. I've heard of happenings where verizon will replace the phone for 50$ but that doesn't happen in my area. And I'm just going to wait for the phone to come in and send in the old one. I spoke to several representatives about this replacement and not at once was I asked if the phone was damaged, and my complaints I said in order to get a replacement were legit, I just put up with them.
