Us servers safe

hi again sorry for all the posts, i have recently been using Europe servers based in amsterdam, but the ssl servers i am using are only in georgia, usa. is it just as safe to use a US server as it is to use a Europe server?

I'm using Giganews which just so happens to be just a few miles from me in Austin, Texas.

Usenet servers are (and have been for many many years), in the U.S., come under 'common carrier' laws and regulations, like the phone company. The telcos cannot be sued for what they 'carry' (i.e., like a bomb threat for instance), or satellite companies (like 'Playboy' or Howard Stern) as they come under 'common carrier' laws. In fact, they are 'required' to carry any and all paid traffic, going back to 1934; very settled law.

And why should we trust that your "source" is any more informed?

The first writer states :

"If you're currently making decisions based on your believe that CPAN is a common carrier, I'd recommend that you check that belief with competent legal counsel."

I'm not familiar with the term or whether it has fuck all to do with NGs, but I'll assume so at the moment for the sake of argument.

The second link is just another forum post. I have no reason to buy into what they're selling any more than the forum post you're attempting to debunk. :ermm:

dont be ridiculous. usenet do not come under common carrier statutes. the services covered are defined by the statutes. if usenet was common carrier then usenet companies could no have a acceptable use policy.
 
That says nothing about Internet, show me law that gives Usenet providers or even Internet providers with common carrier! There are many laws to say many things but pointing at unrelevant law is not useful.

You seem to be the leading expert here. Why don't you kindly show us?

As far as I know, all common carriers have Use Policies :whistling
 
BUT can they 'grass' people up for what they download from their servers???

I don't know any usenetprovider that logs what you download, they just log the amount of traffic.

If you use secure connections you should be even more "safe" but personally I don't think it's going to happen that anyone is spying on you, unless you download/upload child porn etc.
