answer please? two sibling's(Brother & sister of 26 yrs of age twins) domestic physical fight can lead anyone or both to jail?My nephew and niece had physical fight over the laptop(cuz they have one laptop between them)both of them physical hurt each other a little bit.we are new jersey.police did came and just take away to niece to jail for cpl of hours and also took profile criminal records+pics.While nephew stayed home.but both of them now are scheduled to appear in the court on this coming wednesday morning.We don't know much about court thing and lawyer hiring stuff.can anyone of you advice a little bit?what can be done and what we have to do?is it really something to scared of or going to jail?serious answer only please.Thank you very much.

Edit:Both of them have depression and mental problem health history.please take a note of it.
 
Will talk generally since do not know specifics of New Jersey statutes.

1) The victim does not need to press charges for their to be criminal charges. Criminal charges are brought by the State. In many cases, the prosecution will only pursue them if the victim wants charges pressed but, especially in assault cases, many prosecutors will proceed even if the victim wants charges dropped.

2) In recent years, many states have gotten more serious about violence within families adding enhancement provisions if the victim is a relative or paramour. In other words, even if the current charges are misdemeanors, they are very serious charges.

Your niece and nephew really need to talk to separate attorneys who can advise them regarding their options.
