I have a family friend who is thinking about opening a small bakery, but they are just getting started. Their dilemma is that another bakery in KS has the same name as them. From what they have told me no one currently has the name trademarked yet. Should they rush to trademark their name before the people in KS? They live in VA. I know nothing about trademark / copyright law.
Should they trademark or copyright the name and does that keep other people from using it or does it just project the mark itself? Also if this other person beats them to it does that ruin them from using the name or does it go State by State?
