Toyota wants to sue me?

About a couple years ago I was laid off and my new Toyota Camry was repossessed, they sold it at an auction, and now I still owe the left over balance of around $10,000. Also mother co-signed for me. Since I have worked out a plan with them... and was paying it until recentley, I am without a job again due to this horrible reccession. So now we're dealing with their threatening calls again, my mom answered the phone this last time and the woman asked for me, my mom told her she didnt know where I was because I wasnt home, and the women said that they are going to look for me, and that they are gonna take us to court, and that they are also going to sue my mom for fraud... because the car dealer put my mom as the buyer and me as the co-signer! My questions are... if Im not working right now... and have no income... how are they going to sue me? And can they sue my mother and garnish her wages? And do they usually do this or are they just threats? Also my mother offered her $100 dolar payments... and the lady said thats not enough. But I've heard when you offer them a payment they should take it!
 
First, its probably not Toyota suing you. It is whoever gave you the loan for the car. Some bank. When you buy a car you get it financed through a bank. They are the ones coming after you.

What can they do to you? They can garnish your wages. Since you have no income, and you said your mom co-signed for you then yes they can garnish her wages. Did she co-sign for you? If she did not co-sign then they can not touch her.

Last, generally if you are trying to set up a payment and offering to pay something they normally will work out a deal with you. One reason they might not is if you have offered payments or set up a payment plan in the past and defaulted on it, did not pay.

You need to get with some credit counselor, and not one of those things you see on the internet or advertised on TV. a actual true professional. Those things you see advertised on the net or tv commercials about fixing your credit are generally scams and wont help. Maybe find an attorney who deals with bankruptcy. Get yourself some professional help.

Ive had similar problems, but never that bad. I came close to getting a car repo'd once and i learned several lessons from it. First, if you run into problems making payments or think you are gonna have problems making payments call the bank that your loan is through, explain this to them. Be up front and honest about your problems. They would much rather lower your payments and extend your loan out than to go through he problems of repossessing your car and fighting you in court.
 
you have about an 80% chace thay will sue and if you have no income thay will go after the co signer (mom) and if thay win witch thay will. her pay will be garnished.as for the fraud thats just some BS thare was no fraud in how that was done.
 
You and your mother as a co-signer are 100% responsible for the debt, and unfortunately they can and will do anything to collect, including going after your mother and her income and assets.
