She came into my lane and hit me (didn't check her blind spot). After hitting me she sped off. I caught up to her and she immediately started apologizing. But once the police got there she said we "bumped." I continued to stick to my story but she's changed hers several times. Long story short our insurance companies found no one at fault and now I have to pay to get my car fixed. She barely had any damage but my front driver's side was totally screwed up.
Since there aren't any witnesses all I have is my word again hers and a taped conversation we had. I thought about taking her to small claims court because I know she'll lie and her story doesn't even make sense. Could I use the recording in court? The recording law says that as long as one party knows it's being recorded it's valid. And even without the recording could I win against her since her story is so sketchy and ignorant? I just want $500 to fix my door (it doesn't even open).
