I don't understand why the cops wouldn't give you his insurance information? Anyways, yes. Pick up the fucking phone and call everyone on the planet, including lawyers. Some lawyers charge as much as 30% some by the hour, and others as little as 15% or 5% (or so I've heard). Unless you were at fault, you should get a fairly decent settlement. Whatever his insurance company offers you a lawyer can double.
 
They might decide. If it costs more to fix than it does to just pay you the amount it's worth, then there's almost no way they're going to give you the bigger amount. That's the definition of totalled. They may or may not give you the choice, you'll just have to see on that one.

As far as the dude: He may have slammed his feet down purely on instinct and hit the gas, or his throttle may have been stuck shut, or if he was right and had no brakes than the momentum of hitting you a certain way would have definitely been enough to send him somewhere else.
 
Ok I had this happen to my new(used) car a few years ago and was pissed off. Id only had the car for 3 months and some jackass rearended me at a redlight.

Check your trunk light. Mine got jammed in such a way that though I couldnt open the trunk, the light was on and killed my battery. Then It wouldnt start so I had to fix my cables because they had been jarred. So check that much out.

Also if they tell you its a "total loss" make sure it actually is. I really wished I had just made them fix my fucking car because I got saddled with a check for significantly less than what I paid for the car and had to buy a shitty car because I was still paying on my first. Im in serious debt because of it.
 
Someone hit and ran me recently and I drove it around for months, even though it was wobbly b/c I thought I would have to pay a buttload for the premium.

I finally decided to say fuck it, report it and it is now in the shop. I only have to pay 250.00 for the 1700.00 it will cost plus I get 10 dollars a day for everyday it is in the shop. Oh actually will pay a bit more due to the new tire that I will need b/c the other tire wasn't new.

Anywho, file a claim, they will pay to fix your car, life returns to normal.
 
Yeah, so that doesn't mean they'd actually TAKE my car, right? Just give me what it's worth, if it's lower than the cost of the fix, and consider it totaled but I still get to actually keep it? I mean they can't force me to give it up, can they? 'Cuz that'd be crazy.



Aha, exactly! The trunk light thing I mean. I noticed it was still on because the trunk had to be tied shut, not latched, and I thought it might drain my battery so I went in through the back seat and took the light out. It'd be fun to deal with a dead battery on top of that. :rolleyes:

Yeah, that shit is stupid. One of the cops mentioned how she had a friend who still owed like $6000 on her car and her settlement got her $4000. That's one of the reasons I never wanted to make payments on a car - because I'M a good driver but sometimes other people aren't so there could be a situation where you're paying for a car you don't even own anymore. Which totally sucks. I can't believe they're allowed to do that, either, still charge you for it when it's gone. Isn't there some way to get them to write it off or something?

That sucks for you, though. I always have sympathies for anyone with shitty car-luck because I've had loads of that and it's just... awful. :sad:



That's crazy. So how does that work? I mean, is your insurance paying for it? Is that something covered in basic insurance, a hit-and-run thing, or is it like one of the extra options? Of course in this situation I don't need to know, but I'm curious how all this insurance crap works.

Oh, and another question for anyone out there: When (if) it does get to the stage of repair, will I just be able to go to any repair shop I want or do they pick, like, a "preferred" set of repair shops I have to take it to, the choice of whoever is going to be paying for it?

Okay, so I will pay like 320 for the repairs. Then for every day that I can't drive my car and I don't rent one, yes, they pay me 10 a day. I pay about 100 a month so maybe its all fancy /me shrugs.

You can pick your own shop or go with one they suggest, they give you the choice.

Generally if they total your car they'll pay you it's value and then haul it off for parts. You usually don't get to keep a car that's listed as "totaled" nor would you want to as insuring it would be hell. How do you insure a car that has no inherent value? Once it's totaled it's value is $0.

Best bet is to just call the insurance companies, talk to the legal beagles and go from there. You can ask them all of these same questions and get real and honest answers. The thing is, different states have different laws so maybe where you're at you keep a totaled car but here you don't. They'll let you keep it but they reduce the payout because they can't sell it off for scrap.

So we can give you all sorts of answers but really, it's all conjecture based on where we're at and may not apply to you.
 
Which insurance company did the guy have? If it is (I won't use names) the gecko/caveman insurance, I can almost assuredly put your mind at ease as I know from experience they cut settlement checks faster than the police report ink is dry.

I forgot once (ever... and I swear I can't recall not putting my handbrake on as it's a reflexive, instinctive thing for me to do) to put up my handbrake in my truck and left my car in a parking lot. When I came out of the store not 20 minutes later there was my car kissing the right front end of a big ass SUV with a cop writing out the report and a bitch who didn't even attempt to go into the store and ask who owned the gray Passport. I've personally done this myself in the past as it's not a hard thing to do instead of immediately calling the police for a broken headlight. That was all the damage on her car and my headlight was just tilted down. My car rolled (from a dead stop) a total of about 10-12 feet into hers as she was coming down the aisle so there is no way it hit hard at all and I saw what little damage there was. That's when I thought she was somewhat of a bitch for not trying to find the owner of the car.

Anyway, about a week later I got a letter from my gecko/caveman insurance company telling my premium went from around 64/mo to 178/mo for this incident . I contacted them to make sure this wasn't an error and they said no. They settled out of court and since I wasn't in the car at the time of the accident and my car was the one doing the hitting that it was automatically my fault. I immediately switched insurance companies and off the bat dropped my premiums back down to almost where it was before the accident. When I was speaking with my new insurance company and they were reviewing my driving record they were the ones who informed me that Gecko-fucking Caveman Insurance Co. had paid a check of $2800 for her busted headlight!!

So, anyway, let's hope he had that insurance or some other insurance that promises low monthly payments because they have no mercy on their customers if they ever cause an accident and will more than make up for your low premiums by screwing their own through spiked premiums.

Personally, I'd also seek a lawyer if I were you since your car's value won't give you what you would need to spend to replace it. Some insurance companies have great lawyers but typically they all attempt to get the minimum or close to it.
