The car dealer won't produce a title to the car I have paid in full. What should I do?

i purchased a car from a small local dealership.

the dealer kept saying that he would get me the title, but it's been 4 months now, and still no title.

i reported him to the state cop that is over all dmv matters for north carolina, and he said that he was going to get him for letting me drive off with the dealer tags without a title and letting me drive using these dealer tags for 4 months.

the dealer told me it was legal, but in fact, according to the cop, it's not.

the cop said that he was pretty much going to take his dealer's license and either get us the tags or give us our money back.

well, before the cop could get to the dealer, the dealer got put in jail for attempted murder.

the cop now says we may never get the title or the money without goin to court. i can't afford court.

i know it wasn't the smartest thing to do - to drive off without a title. but i do have a bill of sale.

what are all the options i should i be considering in this situation?
his bank still has the title.

Well, it will be much easier if you have saved all of your receipts to use as proof in court. Do you have a bill of sale? Always, no matter how well you feel you know the person, get a bill of sale signed by the seller. Also, make sure you get receipts for all of your payments. Otherwise, when you go to court it will be much harder to prove your case. Here are some things you may consider. Tell him that you'll go to the media. I used to work in the media and there's nothing that will hurt a person's business faster than negative publicity. Also, tell him that you'll be filing a complaint with the Better Business Bureau, (BBB). You can probably use that to bluff him. Otherwise, you'll have to file a claim in a Civil Court. They will send him a subpoena, and he'll have to hire an attorney or defend himself. If he loses the case he'll be responsible for all court's costs and your attorney's fee, too; if you use an attorney, but if you have all the paperwork, receipts, or copies of posted checks he doesn't stand a chance and you don't need an attorney. Good luck to you!
